    Is it mandatory for me to pay gratuity to my employee not serving notice period?

    Hi Mayuri,

    If your employee has completed 5 years before submitting his/her resignation letter, irrespective of serving the notice period, gratuity will have to be paid to your employee. In you case when an employee is not serving the notice period, the gratuity calculation will happen from the date of joining to the last date in the organization.
